Karl Friedrich Christian Krause’s concept of penal law, though little noticed in Germany, can be regarded as almost revolutionary for its time, as it assumes that public law is not only – negatively – intended to delimit and guarantee the citizens’ spheres of freedom. Rather, the law should also promote the welfare of the citizenry. As a result, Krause’s considerations of penal law do not focus on law enforcement alone, but just as much on the resocialization of both (...) the offender and the victim. In contrast to utilitarian positions, the perpetrator must not be instrumentalized for the benefit of society, e. g. for preventative purposes; rather, the offender has a subjective right to be rehabilitated. Chr. hatte die gens Fabia – eine der ältesten und prominentesten patrizischen gentes – ein ganzes Spektrum von Strategien der Selbstdarstellung vor ihren Standesgenossen und dem Volk entwickelt, die besonders dicht miteinander vernetzt waren: Dazu gehörten einerseits die ambivalenten Mythen wie die Abstammung der gens von Herakles, der Untergang der Fabii am Cremera-Bach und ihre Verwicklung in das Desaster an der Allia; die diversen, von prominenten Mitgliedern geweihten Tempel wie diejenigen für Venus und (...) Honos; Monumente wie die Herakles-Statue des berühmten Lysippos, die der später als ‚Cunctator‘ gefeierte Q. Fabius Maximus nach seiner Eroberung von Tarent hatte nach Rom bringen und auf dem Capitol aufstellen lassen, und zwar in unmittelbarer Nachbarschaft mit seiner eigenen Reiterstatue, sowie weitere visuelle Medien und andererseits die performativen Strategien wie spektakuläre Triumphe und andere pompae. Diese wurden durch ein neues Medium ergänzt und erweitert: Vor allem Fabius Pictors bahnbrechende Geschichte Roms sowie die schriftlich verbreitete laudatio funebris des erwähnten Cunctator auf seinen Sohn wurden ein integraler Teil des komplexen Repertoires der multimedialen Strategien der fabischen Selbstdarstellung. The series, founded in 1970, publishes works which either combine studies in the history of philosophy with a systematic approach or bring together systematic studies with reconstructions from the history of philosophy. Monographs are published in English as well as in German. The founding editors are Erhard Scheibe (editor until 1991), Günther Patzig (until 1999) and Wolfgang Wieland (until 2003). From 1990 to 2007, the series had been co-edited by Jürgen Mittelstraß.

The book (in German) on “Solar Energy – challenge for research, development and international co-operation” is the report of a study group of the Akademie der Wissenschaften zu Berlin. It reviews solar thermal, photovoltaic, and bio mimetic solar energy techniques; prospects of de-central techniques in developing countries; transport and storage of solar energy; and chances for cooperation with Arabic countries and countries of the South of the former Soviet Union. The prospect of large scale energy production in arid areas, and (...) the modern potentials of conducting electricity over long distances by high-voltage DC transmission (V, 2.1) are particularly relevant for the concluding section. Political chances as well as risks were considered for reliable long term cooperation with various Arab countries on these issues. The recommendations appear to be still appropriate 25 years after the book was published, particularly the political advice in favour of cooperation between Europe and suitable countries of the Maghreb. The global time scale of implementation (discussed in chapter I, 7.2) is of the same (high) magnitude as that of other major changes in the history of technology, such as the substitution of sailing ships by steamboats which took almost a century. This paper reports research on the influence of corporate and individual characteristics on managers'' social orientation in Germany. The results indicate that mid-level managers expressed a significantly lower social orientation than low-level managers, and that job activity did not impact social orientation. Female respondents expressed a higher social orientation than male respondents. No impact of the political system origin (former East Germany versus former West Germany) on social orientation was shown. ABSTRACT While Joseph Hooker was considering his upcoming presentation on the geographical distribution of species, he asked Charles Darwin for help with some references. During the ensuing exchange of correspondence, Darwin seems to have contradicted himself, regarding his being aware of Leopold von Buch’s observation that distributed varieties become species, prior to writing On the Origin of Species. Literalists and conspiracists have interpreted this apparent self-contradiction as a sign of duplicity and fraud. However, when the correspondence and Hooker’s address are (...) analysed in context, there is a more compelling explanation. Simply that, in response to direct questioning by Hooker, Darwin conflated the two names of Von Baer and Von Buch, and made an honest mistake. (shrink)

Although most Turks in Germany belong to the second or third generation of immigrants, they have retained the social, cultural, and religious identity of their country of origin. This article deals with this double identity of young Turks in Germany and their language-bound exposure to television, radio, press, and the Internet. Telephone survey data are presented regarding the integration and media use of Turks in Germany. The survey was carried out in 2006 on behalf of the public (...) broadcasting station of North Rhine-Westphalia. The analyses identify and describe different types of integration of Turks and investigate the relationship between their level of integration and their demographic profile as well as their patterns of media use. Causal analysis was focused on the question how different strategies of acculturation influence the use of mass media. (shrink)

Die Erregung, mit der in den 1960er-Jahren der von Theodor Adorno und anderen so genannte „Positivismusstreit“ ausgetragen wurde, hat sich in den fast 50 Jahren, die vergangen sind, seit 1969 der Sammelband zur Debatte veröffentlicht wurde, weitgehend gelegt. Das macht es möglich, von der Parteinahme für die eine oder andere Seite Abstand zu nehmen und noch einmal präziser die Argumente von damals zu durchdenken. Es zeigt sich, dass in der Diskussion zwischen Karl Popper und Theodor Adorno in Tübingen 1961 (...) die Gemeinsamkeiten die Divergenzen bei weitem überwogen. Erst mit dem Eintritt on Jürgen Habermas und Hans Albert in die Debatte kam eine polemische Schärfe in die Diskussion, zum Teil durch die Etikettierung der Position Poppers als „Positivismus“ durch Habermas und dann auch Adorno. Zusätzlich wird hier versucht, die Debatte der 1960er-Jahre dadurch zu historisieren, dass sie in einen weiteren Zeitrahmen eingebettet wird, der einerseits die weit in die 1920er- und 1930er-Jahre reichende Vorgeschichte des Streits sowie andererseits die Folgen der Auseinandersetzung seit den späten 1960er-Jahren einbezieht.Die Darstellung beruht auf früheren Arbeiten des Verfassers. Zusätzlich werden einige neue Archivfunde präsentiert und inzwischen erschienene Autobiografien bzw. Biografien der Beteiligten des Positivismusstreits ausgewertet. Es bleibt zu hoffen, dass sich in Zukunft die bislang nicht zugänglichen Teile des Briefwechsels zwischen Adorno und Popper noch auffinden lassen. (shrink)

This article provides an account of the language standardization process in Germany during the 18th century. Linguistic activity as a means of social definition and differentiation is discussed with respect to class relations within the absolutist states in Germany. The linguistic awareness of different social classes expressed in the debates on linguistic standards of language unification supports the assumption of an asymmetric modernization process which is based not only on conditions such as literacy, education and economical subsistence but (...) at the same time on the bourgeois' claim for hegemony. German literature played an important role in Kierkegaard's reading, and he often relates to German authors in his writings, especially to those of the period between 1770 and 1830. Against the background of German Romanticism, he deals with Romantic irony in the second part of The Concept of Irony. His harsh verdict on famous German writers like Friedrich Schlegel and Ludwig Tieck in his master's thesis is in some cases relativized by a more balanced appreciation in other writings. Some German (...) authors like Georg Christoph Lichtenberg and Jean Paul served as stylistic models, while others like Gotthold Ephraim Lessing offered valuable inspirations for his thinking. One of the most frequently cited poets is Johann Wolfgang von Goethe, who appears in Kierkegaard's writings throughout all his working periods and is dealt with in a very comprehensive manner. Bentham was once thought to be the father of the principle which he called ‘the greatest happiness principle’. Now Hutcheson with his ‘greatest happiness for the greatest numbers’ is the generally accepted source of this test of moral behaviour. It is not in Britain, however, but in Germany that one finds its origin. A quarter of a century before Hutcheson's An Inquiry into the Origin of our Ideas of Beauty and Virtue, a German philosopher provided a formulation of the (...) principle on which Hutcheson relied. Cet article, qui s’appuie sur les récits de vie de trois femmes arrivées à Berlin après avoir fui l’Afghanistan et la Syrie, conteste la validité des représentations des réfugiées comme des victimes de cultures patriarcales devant être sauvées et libérées. Il montre au contraire que ces femmes, luttaient déjà pour leur liberté dans leurs pays d’origine, et que l’expérience de l’exil a même été un moment d’empowerment pour certaines d’entre elles. In the 1970s, a multifaceted alternative scene developed in West Germany. At the core of this leftist scene was a struggle for feelings in a capitalist world that seemed to be devoid of any emotions. Joachim C. Häberlen offers here a vivid account of these emotional politics. The book discusses critiques of rationality and celebrations of insanity as an alternative. It explores why capitalism made people feel afraid and modern cities made people feel lonely.
